The right to withdraw from the contract

A customer who is a consumer has the right to withdraw from the sales contract within 14 days without giving a reason. The deadline for withdrawal from the contract expires after 14 days from the date on which the customer came into possession of the item or on which a third party other than the carrier and indicated by the customer came into possession of the Product.

To exercise the right to withdraw from the contract, please inform us, i.e. Grzegorz Niewiński conducting business under the name Gizo Grzegorz Niewiński at the address Złotoria 225, 16-070 Choroszcz, e-mail: czesci@gizo.pl, about your decision to withdraw from the sales contract by means of an unambiguous statement sent to us by post or electronically to the addresses indicated above.

The customer may use the sample withdrawal form attached as Appendix 1 to the Regulations of our Online Store. Using the form template is not obligatory. 

In order to meet the deadline for withdrawal from the contract, it is sufficient for the customer to send information regarding the exercise of his right to withdraw from the contract before the deadline for withdrawal from the contract expires.

We would like to inform you that the right to withdraw from a distance contract does not apply to contracts specified in Art. 38 of the Act of 30 May 2014 on consumer rights.

Consequences of withdrawal from the contract

In the event of withdrawal from this contract, we will refund to the customer all payments received from him, including the costs of delivering the goods (with the exception of additional costs resulting from the customer's chosen delivery method other than the cheapest standard delivery method offered in our Online Store) immediately, and in any case no later than 14 days from the day on which we were informed about the decision to exercise the right to withdraw from this contract. We will refund the payment using the same payment methods used by the customer in the original transaction, unless the customer has expressly agreed to a different solution; in any case, the customer will not incur any fees in connection with this refund. 

Please be advised that we may withhold the refund until we receive the Product or until you provide us with proof of its return, depending on which event occurs first.

Please return the Product to the following address Gizo Grzegorz Niewiński, ul. Sadowa 21, 05-850 Jawczyce, immediately, and in any case no later than 14 days from the day on which we are informed about the withdrawal from the sales contract. The deadline is met if the Product is returned before the 14-day deadline expires.

We would like to inform you that the customer will be obliged to bear the direct costs of returning the items.

WARRANTY FOR PRODUCT DEFECTS

Pursuant to Art. 556 of the Act of April 23, 1964 Civil Code The Seller is liable to the customer if the Product sold has a physical or legal defect. The seller is released from liability under the warranty if the customer knew about the defect at the time of concluding the contract.

Based on Article. 558 of the Civil Code, in the event of selling the Product to a customer who is not a consumer, the Seller's liability under the warranty is excluded.

Delivery of the Product as part of the exercise of rights arising from the warranty for defects takes place at the Seller's expense.

The Seller is liable under the warranty if the defect is discovered within two years from the date of delivery of the Product to the customer.

The warranty does not cover defects resulting from incorrect use of the products.

Reports of Product defects should be sent electronically to the following address: czesci@gizo.pl or in writing to the address of the Seller's seat.

If the sold item has a defect, the customer may submit a declaration of price reduction or withdrawal from the contract, unless the Seller immediately and without excessive inconvenience to the customer replaces the defective item with a defect-free one or removes the defect. This limitation does not apply if the item has already been replaced or repaired by the Seller or the Seller has not fulfilled the obligation to replace the item with a defect-free one or remove the defect.

Instead of removing the defect proposed by the Seller, the Customer may request that the item be replaced with a defect-free one or instead of replacing the item, request that the defect be removed, unless bringing the item into compliance with the contract in the manner chosen by the Customer is impossible or would require excessive costs compared to the method proposed by the Seller.

The customer cannot withdraw from the contract if the defect is immaterial

If it is necessary to assess physical defects, the Product should be delivered to the following address: Gizo Grzegorz Niewiński, ul. Sadowa 21, 05-850 Jawczyce.

The Seller responds to the customer's notification within 14 calendar days from the date of its receipt. Failure to consider the application within the specified deadline is tantamount to its acceptance.

The Seller covers the costs of removing defects or replacing the Product with a new one.
